The project investigates the regulation of surveillance within Europe, focusing on the judicial interpretation of existing legal frameworks by the Court of Justice of the European Union (CJEU) and the European Court of Human Rights (ECHR). This research analyses key case law from both courts to understand how their rulings contribute to the constitutionalisation of mass surveillance in Europe. By dissecting the courts’ decisions, it aims to provide insights into the balance between the need for state security and the protection of individual rights, offering a comprehensive view of the legal boundaries governing surveillance in Europe.
Edoardo Celeste is an Associate Professor of Law, Technology and Innovation at the School of Law and Government of Dublin City University. Edoardo is the Programme Chair of the Erasmus Mundus Master in Law, Data and Artificial Intelligence (EMILDAI), the Deputy-Director of the Dublin European Law Institute (DELI), the coordinator of the DCU Law and Tech Research Cluster, and a founding member of the Digital Constitutionalism Network.
Nauani Benevides is a Brazilian qualified lawyer with experience in litigation, corporate law and legal research. Currently pursuing a European Master in Law, Data, and Artificial Intelligence (EMILDAI), she specialises in the intersection of law and technology and has a keen interest in Artificial Intelligence Governance. She is also a certified Privacy and Data Protection Specialist (CIPP/E), a member of the International Association of Privacy Professionals (IAPP), and co-editor of the EMILDAI’s blog for 2024-2025.
