Digital constitutionalism in Brazil: Freedom of expression in the digital era
Summary
The research investigates the emergence of digital constitutionalism in Brazil, focusing on the impact of the digital era on freedom of expression and democracy. It aims to address how constitutional law can mitigate the risks posed by algorithmically mediated platforms to democracy, as well as to fundamental rights and freedoms, emphasizing the role of constitutional law in protecting rights and limiting the power of private entities performing “quasi-public” functions. While focusing on the Brazilian context, a legal-comparative approach will be employed due to the transnational nature of the challenges identified.
